Mr. R’s motorcycle was struck by a drunk driver. Unfortunately, after the accident, the drunk driver fled the scene. Mr. R. had to use his uninsured motorist coverage to get paid for his injuries and pain and suffering.
Mr. R sustained injuries to his neck and shoulder. The insurance company contested the cause and extent of damages. They claimed that the accident did not cause the injuries nor were they as extensive as the plaintiff claimed they were. The insurance company claimed that the plaintiff was malingering.
